Swedish regulator suspends 5G spectrum auction following court decision on Huawei

The Administrative Court of Stockholm suspended the PTS’s decision to ban operators from using Huawei and ZTE equipment in their network deployments.

The PTS banned operators from using Huawei and ZTE: The Swedish regulator, the PTS, planned an auction of spectrum in the 2.3GHz and 3.5GHz bands, which was scheduled to start on 10 November 2020. As part of the licence conditions, the PTS decided that operators would not be able to use Huawei or ZTE in their network deployments. If existing infrastructure were used to provide services in those bands, operators would have to phase out Huawei and ZTE by 1 January 2025.

A court suspends the decision: Huawei appealed the decision of the PTS. On 9 November 2020, the Administrative Court of Stockholm ruled an ‘inhibition’ of the licence conditions related to Huawei. The ruling suspends the ban, though it is not a decision on merit.

The PTS delayed the auction: Following the Court’s ruling, on 9 November 2020 the PTS suspended the auction. The regulator stated it will analyse the Court’s decision, and plans to start the auction as soon as possible, though it did not indicate any specific time frame.
